Terms Of Service

The following conditions apply to the hire of any item, including marquees and equipment, by us, SBS Simple But Significant (referred to as "SBS"), to you, the customer. In these conditions, the word ‘equipment’ includes any item hired by us to you.

The terms of these conditions can only be altered with our written agreement. Any condition contained in any booking form or other communication by you that is inconsistent with any of these conditions will not be deemed accepted unless we have agreed to your condition in writing.

If you have any queries or issues regarding the terms and conditions listed below, please contact us before accepting the quote proposal and confirming the booking.

1. Acceptance of Quotation:

A binding contract will exist only once you have accepted our quotation by signing the agreement and paid a deposit of 20% of the total invoice into our bank account.

2. Basis of Quotation:

All quotations are made subject to the following terms:

  • Hire charges do not include attendance by SBS employees for any purpose other than erecting and dismantling the marquee and associated equipment.

  • Hire quotes for furniture and other items do not include setup, dismantling, or placement unless specifically stated.

  • The hire period refers to the duration for which the equipment is required to be ready for use.

  • You confirm that the site is suitable for the erection of the equipment and have informed us of any drains, pipes, cables, or obstacles that may affect installation. You are responsible for repairing any damage caused by the installation or dismantling process.

  • The site must be clear of obstacles before the delivery of the marquee. If we have to remove obstacles, we will not be held responsible for any damage caused.

  • You will be liable for any additional costs if extra work or equipment outside the agreed terms is required or if the equipment is used beyond the agreed hire period.

  • Furniture and linen should be packed and returned in the same manner as received.

3. Payment:

A minimum deposit of 20% of the total hire invoice is required to confirm your booking. The remaining balance must be paid no less than 5 days before the scheduled setup date.

4. Delay:

SBS will not be held liable for any delays or failure to complete contracts due to the following:

  • The site being unsuitable or inaccessible on the scheduled delivery date.

  • Adverse weather conditions, including wind, rain, or storms.

  • Loss or damage caused by fire, flood, or any other unforeseen events.

  • Industrial disputes, strikes, or any external factors beyond our control.

5. Adverse Weather:

If the weather forecast predicts conditions that exceed the manufacturer’s wind speed rating within five days of installation, the marquee cannot be installed. In such cases, the full hire charge is still payable by the client. We recommend event insurance to cover these risks.

6. Delivery to Site:

  • The site must be available and in suitable condition for installation at the agreed time.

  • If the site is inaccessible or unavailable due to client-related issues, SBS reserves the right to charge a penalty rate of $30 per hour per team member for any delay.

  • If no responsible person is available at the time of delivery, we will make reasonable attempts to contact the client. If unsuccessful:

    • Delivery will be deemed complete, and you will be responsible for the items.

    • We will erect the marquee as we see fit, following any provided plans as closely as possible.

    • If you request that we relocate any erected marquee for reasons outside our control, you will be liable for additional charges.

7. Ownership:

All equipment remains the sole property of SBS Simple But Significant. You may not sub-hire, transfer, or allow any lien to be created over the equipment during the hire period.

8. Cancellation:

If you cancel the contract, any deposit paid will be forfeited.

9. Care of Equipment:

You are responsible for keeping the hired equipment in reasonable condition throughout the hire period. Excessive mud or soiling must be removed before our team retrieves the equipment. Additional charges may apply if cleaning on-site is required.

  • Heating and cooking appliances must be placed at least six feet away from the marquee panels and should not be left unattended while in use.

  • No heating or cooking is permitted inside the marquee except for electrical appliances or approved butane/propane gas devices. Outdoor barbecue equipment must be placed at least fifteen feet away from the marquee.

  • Furniture and linen should be stacked and packed the same way they were left upon removal.
